    All models, actors, actresses and other persons who appear in any visual recordings of actual conduct of a sexual nature or otherwise contained on this website were at least eighteen years of age at the time the recordings were made. With respect to all products posted on this site, whether they depict actual sexual conduct, simulated sexual content, or otherwise, all persons in said recordings were at least 18 years of age at the time the described recordings were created.

    DEFINITIONS

    Customer – a natural person with full legal capacity, a legal person or an organizational unit without legal personality but with legal capacity, making a purchase from the Seller directly related to its business or professional activity.
    Consumer – a natural person of full legal capacity, making a purchase from the Seller not directly related to his/her business or professional activity.
    Buyer – both Client and Consumer.
    Price – the gross price of the Goods in Polish zloty or Euros, depending on the Buyer’s choice, placed next to the information about the Goods, not including the shipping costs of the Goods.
    Regulations – these Regulations, available at: https://www.owiaks.coml/regulamin
    Store – Internet service available at https://www.owiaks.com/, through which the Buyer can place an Order.

    BANK ACCOUNT:

    Product/Electronic Product – an indivisible and minimum quantity of things that can be the subject of an Order. Available in the Store and offered by the Seller for retail sale. Given as a unit of measurement by specifying its price (price/piece of the product).
    Order – an order for Products placed by the Buyer in the Store in accordance with these Regulations. Making Orders in the Store is possible 24 hours a day, all days of the year.

    GENERAL PROVISIONS

    (1) Through the Store, the Seller sells video productions in the form of direct streaming from the site.
    (2) The purchase of access to recordings is conditional on the registration of the Buyer with proof of age and the creation of an Account on Owiaks.com.
    (3) Buyer may place an unlimited number of Orders.
    (4) In order to use the online store, the Buyer should access a computer workstation or terminal device on his own. To place an Order, it is sufficient to have access to:
    1. internet connection,
    2. a standard web browser,
    3. an active e-mail address and telephone number.
    5. the Terms and Conditions are an integral part of the sales contract concluded between the Buyer and the Seller. It defines the terms and conditions of use of the Store and determines the rights and obligations of the Seller and the Buyer.
    6th All product prices shown on the pages of the Store are gross prices in Polish Zloty (PLN) or Euro (EUR).
    7th It is forbidden for the Buyer to provide unlawful content and use the Store, website or free services provided by the Store, in a manner contrary to applicable law, morality, violating the personal rights of third parties or the legitimate interests of the Store.
    (8) Any announcements, advertisements, price lists and other information on the pages of the Store do not constitute an offer within the meaning of the Civil Code, but are an invitation to conclude a contract, subject to point 3. IV.
    (9) The Buyer in the use of any Product shall not be entitled to:
    distribute it or market it, either in whole or in fragments;
    interfere with its content;
    publication,
    distribution,
    duplication;
    remove the owner’s markings and technical protections;
    lease;
    any commercial use.
    (12) The Buyer acquiring a Product from the Store shall take care

    that no unauthorized persons use it in a manner inconsistent with the law or these Regulations, because in the event of detection of such situations, the publisher may direct claims against the known purchaser of the Product (Buyer) for infringement of rights to products marked with a registered, legally protected trademark.

    PLACING AN ORDER

    (1) Electronic orders have no territorial restrictions.
    (2) The Buyer wishing to make an order on the Store’s website, selects a specific product/products by clicking on the “to cart” button, and then determines the method of payment. After performing the aforementioned actions, he confirms the order by clicking on the “Buy and Pay” button.

    4th Confirmation of the Order is an electronic message sent to the email address provided by the Buyer.
    5. the Buyer is informed of changes in the status (stages of completion) of the order via e-mail.

    FORMS OF DELIVERY AND METHODS OF PAYMENT

    (1) The Buyer can choose the following methods of delivery of the Products covered by the Order:
    1. streaming access to the products directly from the store’s website
    2. online payment service provider is przelewy24

    Available forms of payment:
    1. payment by credit card
    2. quick payments przelewy24, Vendo
    3. if the Buyer has selected “przelewy24” as a form of payment, he will be redirected to the page of the przelewy24 system to make payment. After the payment is made, you will be returned to the page with confirmation of the Order. At this moment, the contract of sale of the Products covered by the Order is considered concluded between the Buyer and the Seller.

    If there is a need for a refund for a transaction made by the Buyer with a payment card:
    1. the Seller made a refund to the bank account assigned to the Buyer’s payment card
    2. the Seller shall refund the payment using the same method of payment used by the Buyer, unless the Buyer has expressly agreed to a different method of refund

    ORDER PROCESSING

    (1) Once the Buyer has placed and paid for the Order, he/she will receive an email confirming the Order and access to the ordered product or subscription
    2. the Order processing time is calculated from the moment of positive payment authorization.

    WITHDRAWAL FROM THE CONTRACT

    (1) A buyer who has concluded a contract at a distance or off-premises contract has the right to withdraw from it without giving any reason within 14 days.
    (2) In accordance with Article 38 of the Law on Consumer Rights, the right to withdraw from a contract concluded off-premises or at a distance is not granted to the consumer with respect to contracts: for the supply of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the consumer before the expiration of the deadline for withdrawal and after the entrepreneur has informed him of the loss of the right to withdraw from the contract. After logging into the profile with access to purchased products (digital content), the consumer loses the right to withdraw from the contract.

    PERSONAL DATA AND COOKIES

    (1) The administrator of the Buyer’s personal data is the Seller.

    Complaints:

    Owiaks SL supports a complaint process that allows for the reporting of content that may be illegal or otherwise violates the Visa and Mastercard Rules. Any complaint will be addressed within seven (7) business days. In the event there is evidence of illegal content, we will proceed to remove it immediately. Please send your complaint/content removal requests to the email address owiakscouple@gmail.com.

    OUT-OF-COURT MEANS OF REDRESS

    (1) The Buyer has the opportunity to use out-of-court means of complaint handling and claim investigation. Among other things, the Buyer has the option to:
    1. to apply to a permanent amicable consumer court to resolve a dispute arising from the concluded Sales Agreement,
    2. use the assistance of the district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
    (2) More detailed information on out-of-court ways of dealing with complaints and claims, the Buyer can look for at the website http://www.uokik.gov.pl.
    (3) The Buyer may also use the ODR platform, which is available at http://ec.europa.eu/consumers/odr. The platform is used to resolve disputes between consumers and businesses seeking out-of-court settlement of disputes regarding contractual obligations arising from an online sales contract or service contract.

    FINAL PROVISIONS

    The Regulations shall come into force on January 24, 2022.
    (2) The Regulations of the Store are subject to change. Each Buyer will be informed about the content of changes to the Rules and Regulations by posting a message about changes to the Rules and Regulations on the Store’s website, including a summary of the changes and maintaining this information for a period of 14 calendar days. Information about the change of the Regulations, will be made no later than 14 calendar days before the introduction of the amended Regulations.
    (3) If a registered Buyer does not accept the new content of the Rules and Regulations, he is obliged to notify the Store of this fact within 14 days from the date of information about the change in the Rules and Regulations.
    (4) The amended Regulations are binding on the Buyer if the requirements set forth in Article 384 of the Civil Code have been met.
    5th Amendments to the Rules shall in no way affect the acquired rights of the Buyer using the online store before the date of entry into force of changes, in particular, changes to the Rules will not affect the already made Orders, concluded or executed Agreements.
    (6) The Shop strives to resolve disputes with the Consumer in the first instance in an amicable manner, in a situation where this form fails to produce results, the court of competent jurisdiction to resolve disputes is a court of competent jurisdiction under applicable law.
    (7) All archival versions of the Terms and Conditions are available for download in .pdf format below these Terms and Conditions.
    (8) In matters not covered by these Regulations, the provisions of Polish law shall apply.
